Equipment Rental Agreement

1. Disclaimer

Every effort is made to ensure descriptions and prices are correct. Lessor reserves the right to correct errors as needed. All prices and availability are subject to change without notice.

2. Lease

Lessor hereby leases to Lessee the equipment ("Equipment") shown in the order confirmation. The Equipment remains Lessor's property at all times.

3. Shipping

Lessee agrees to pay both outgoing and return shipping charges at the time of checkout, unless otherwise agreed.

• Lessor cannot guarantee a specific delivery date. Shipping times are estimates only.
• Use of shipping methods other than those arranged by Lessor may result in late fees.

4. Rental Period

The rental period begins at the first attempted delivery or the start date shown on your receipt. The rental period expires on the date shown on your receipt. Equipment must be returned to the shipper by end of business on the last day of the rental period.

5. Payment

Rent and deposit (if applicable) must be paid in full upfront.

6. Late Returns

Late returns are penalized at 25% of the 4-day rental rate per day. Penalties will be charged to Lessee's payment method on file.

• Equipment not returned within 7 days after the due date will be considered stolen and Lessee will be charged the full replacement value.
• If Lessor is unable to collect penalties or replacement value after 7 days, Lessee shall be in default.
• Lessor reserves the right to pursue all civil and criminal remedies for unreturned equipment.

7. Proper Use

Lessee shall use the Equipment in a careful and proper manner and comply with all applicable laws.

8. Cancellation by Lessor

Lessor reserves the right to cancel any order for any reason before delivery.

9. Cancellation by Lessee

Lessee may cancel an order at any time before Lessor transfers the Equipment to the shipper.

10. Ownership and Intellectual Property

The Equipment remains at all times the sole property of Lessor. Lessee has no rights or claims to the Equipment. Lessor makes no claims to images, video, or sound recordings made by Lessee while using the Equipment.

11. Damaged or Modified Equipment

Lessee assumes and shall bear the entire risk of damage to the Equipment from any cause during the rental period.

• Lessee shall keep the Equipment in good repair and condition.
• Lessee shall not modify or alter the Equipment.
• Pre-existing damage must be reported to Lessor within 24 hours of receipt, or it will be assumed the damage occurred during the rental.
• In the event of damage, Lessor shall choose the repair method and facility.
• Lessee is responsible for the total cost of repair, whether performed externally or in-house.
• If Lessee's payment method cannot be charged within 24 hours, Lessee shall be in default.
• A cleaning fee may be charged if equipment is returned with smoke, mud, dirt, sand, or other contamination.

12. Lost or Stolen Equipment

Lessee assumes and shall bear the entire risk of loss of Equipment from any cause during the rental period.

If Equipment is lost or stolen, Lessee is liable for the full replacement value.

• Lessor shall charge Lessee's payment method for the replacement value.
• If payment cannot be collected within 24 hours, Lessee shall be in default.
• If Lessee used an alternate shipping method not arranged by Lessor and Equipment is lost in transit, Equipment is considered unreturned and Lessee is liable.

13. Missing Accessories

Lessee is fully liable for the replacement cost of any missing accessories (caps, hoods, bags, cables, etc.).

14. Default

In the event of default, all amounts owed are immediately due.

• Lessee shall be responsible for all collection costs, including attorney fees.
• Lessor reserves the right to pursue all civil and criminal remedies, including debt collection, repossession, and criminal charges.

15. Liability and Indemnification

Lessor does not assume any liability for equipment use or malfunction. Lessee assumes all liability arising from use or failure of the Equipment. Lessee indemnifies Lessor against any claims resulting from Equipment use.

16. Shipping Delays and Malfunctioning Equipment

In case of shipping delays or equipment malfunctions, Lessor's only liability is for the portion of rent applicable to the affected time period. Lessor is not responsible for consequential or incidental damages.

17. Taxes and Duties

Lessee agrees to keep the Equipment free of any taxes, duties, liens, or encumbrances. Lessee shall reimburse Lessor in full for any such charges.

18. Governing Law and Jurisdiction

This Agreement represents the entire agreement between Lessor and Lessee. If any portion is found unenforceable, the remainder shall remain valid. This Agreement is governed by the laws of the State of California. California courts have exclusive jurisdiction over any disputes.
